STAY COMPLIANT

Marketing Your Connecticut Dispensary

Connecticut has emerged as a pivotal state in setting the benchmark for cannabis regulation at the state level, following its legislative developments to legalize cannabis use. As the state advances in its cannabis reform journey, it progressively forges a path towards a well-regulated industry, much like the alcohol sector.

The relationship between the state of Connecticut and the burgeoning cannabis industry is multifaceted, characterized by a dynamic legislative landscape. With each legislative session, the intricacies of cannabis sales and marketing regulations grow, mirroring the complexity of the industry itself.

The Connecticut Department of Consumer Protection is responsible for the oversight of cannabis establishments and has established comprehensive marketing and advertising guidelines. These regulations are centered around several core objectives:

  • Targeting an audience that is verifiably above the legal age of consumption
  • Providing exhaustive warnings about the product to ensure consumer safety
  • Regulating the manner and visibility of cannabis advertising to uphold public and legal standards

Cannabis establishments in Connecticut must navigate several advertising restrictions designed to prevent appeals to underage individuals and ensure accurate representation of cannabis products.

Ads must not target those under 21, including using imagery like cartoons that appeal to minors.

Cannabis cannot be advertised with any claims of curative or therapeutic effects unless specifically permitted.

No visible advertising within 500 feet of places frequented by minors such as schools and parks.

Restrictions on advertising in or on public and private vehicles and at transport hubs.

Online advertisements and social media posts must be designed to reach an audience that is at least 90% aged 21 or older.

The law outlines detailed rules for advertising through various media, as well as restrictions related to event sponsorships.

Billboards are heavily regulated, particularly concerning their proximity to schools and the timing of the displayed ads.

Use of location-based advertising on devices is allowed under strict conditions that ensure the target audience is of legal age.

Sponsorship of events is allowed only with evidence that the majority of the audience is over the legal age limit.

Ads must not encourage any illegal activity, including transporting cannabis across state lines.

Cannabis advertisements must feature mandatory warnings, and cannabis-related websites are required to verify the age of their users.

Ads must clearly state that cannabis is not for use by individuals under 21 and should be kept out of reach of children.

The warning must be conspicuous in print or visual media, and intelligible in audio advertisements.

Cannabis websites must include an age verification step to ensure users are 21 or older before they can access any content.

While most forms of cannabis advertising are strictly controlled, there are specific allowances for outdoor signage directly at the business location.

Allowances are made for outdoor business signs that contain only the name and logo of the establishment.

These signs must not show the cannabis plant or part of it and must be limited in color use.

Signs are allowed on the business premises or on commercial property with multiple tenants, including the cannabis establishment.
