Marketing Your New Mexico Dispensary
New Mexico's advertising and marketing guidelines for cannabis are specified in N.M. Code R. § 16.8.3.8, aiming to ensure ethical promotion practices that safeguard public health and prevent appeal to underage audiences.
Cannabis advertising in New Mexico must meet rigorous standards to maintain industry integrity and consumer safety.
Responsible Identification: Ads must accurately identify the responsible parties.
Audience Age Expectation: Ad placements should be in areas where at least 70% of the audience is expected to be 21 or older, verified by reliable data.
Statements and Warnings: Advertisements must contain specific statements and warnings about responsible consumption and potential risks.
The state outlines specific prohibitions to prevent misleading marketing and protect minors from exposure to cannabis advertising.
Restricted Media Channels: Advertising is not allowed on certain broadcast media and in specific locations without proof that the audience is predominantly adult.
Content Restrictions: Ads must not be misleading, contain unproven health claims, or be designed to appeal to minors.
Location-Based Restrictions: Visual media ads cannot be within 300 feet of sensitive areas like schools and daycare centers.
While branding is distinguished from advertising and marketing, it is subject to its own set of regulations.
Child Appeal: Branding must not include elements that appeal to children, such as cartoons or images commonly used to market to minors.
Non-Marketing Nature: Branding is not considered marketing or advertising and is thus exempt from warnings and statement requirements.
The New Mexico Cannabis Compliance Board ensures that advertising regulations are followed and has the authority to demand the removal of non-conforming advertising.
Removal of Violating Ads: Licensees must remove any non-compliant ads as directed by the Commission.
Notification of Violations: The Commission will notify licensees of violations and provide a timeframe for correction.
