In 1911, Massachusetts led the way by being the first state to implement restrictions on cannabis at the state level. Fast forward to 2016, and the state's voters chose to legalize recreational cannabis use. Today, Massachusetts stands as a leader in cannabis reform, progressively working towards a well-regulated cannabis industry akin to the alcohol market.

The state's relationship with cannabis and the evolving regulations surrounding the industry is extensive. With continuous legislative changes, the rules regarding sales and marketing of cannabis are becoming increasingly intricate.

The Massachusetts Cannabis Control Commission has set forth stringent marketing and advertising guidelines addressing three primary concerns:

  • Ensuring that the target audience is of legal age
  • Providing comprehensive warnings about the product
  • Regulating the visibility and approach of cannabis advertising

Age Restriction Guidelines:

Advertising campaigns for television, radio, mobile apps, social media, and online platforms must target audiences where advertisers expect a minimum of 85% to be 21 years or older.

Marketing should not feature individuals under 21 nor include mascots, cartoons, sponsorships, or celebrity endorsements that could appeal to those under 21.

Ensure your brand’s website incorporates an age verification process to confirm visitors are at least 21.

Product packaging must be in non-transparent or simple, child-proof containers, verified by a recognized packaging evaluation firm, and resealable if containing more servings.

Avoid packaging designs that could attract minors, including the use of vivid or fluorescent colors, mimicking non-cannabis consumer goods, or incorporating cartoons, symbols, celebrities, images of minors, or language typically marketed towards minors.

Products intended for repeated use must be easily divisible into single servings, with clear scoring for solid edible products.
